1. Scope and provider
These terms of use apply to the use of influace (influace.de) with a customer account. The provider is Tom Esders, Jutastr. 11, 80636 Munich, Germany, email: mail@tesders.de ("we").
influace is intended for companies, agencies and self-employed professionals looking for influencers for their commercial or professional activities. Deviating terms of users do not apply, even if we do not expressly object to them.
2. Services
influace is a search engine for influencers in the German-speaking region. With an account, users can search for influencers, view profiles, and manage the settings of their account and organization. Use is currently free of charge. If we introduce paid services, separate terms apply, which the user expressly accepts before booking.
The data shown is based on publicly available information and on automated analysis. We strive for current and correct information but give no guarantee of completeness, accuracy or timeliness, for example regarding reach, topics or collaborations.
We may develop, change or restrict the range of features where this is reasonable for the user.
3. Account and organization
An account requires a valid email address and a password; the email address must be confirmed. Every account belongs to exactly one organization, such as the user's company or agency. Anyone who creates an organization or is invited to one confirms that they are authorized to do so.
Users keep their credentials and passkeys confidential and inform us without delay if they suspect misuse. An account is personal and must not be passed on to third parties.
4. Permitted use
Users may use influace only in accordance with these terms and applicable law. In particular, it is prohibited to:
- retrieve, copy or collect content or data automatically, for example by scraper, crawler, bot or script, unless we expressly provide an interface for this;
- systematically reproduce data from influace, transfer it into own databases or make it available to third parties;
- circumvent technical protection measures, access restrictions or usage limits, or disrupt operation;
- contact people found via influace unlawfully, for example with advertising without consent, or process their data in breach of data protection law.
The user is solely responsible for contacting influencers and for processing their data.
5. Availability
We strive for operation that is as free of disruption as possible but owe no particular availability. Maintenance, further development and disruptions beyond our control may temporarily restrict use.
6. Rights to content
The platform, its software, texts, analyses and compilations are legally protected. Users receive a simple, non-transferable right to use influace as intended for the duration of their account. Rights to third-party content, such as images from social networks, remain with the respective rights holders.
7. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. In the event of a slightly negligent breach of an essential contractual obligation — an obligation whose fulfilment makes proper use possible in the first place and on whose observance the user may regularly rely — liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.
8. Suspension and termination
Users can delete their account at any time in the settings. We may end the use with two weeks' notice. The right to terminate for good cause remains unaffected; good cause exists in particular in the event of breaches of section 4. If there is reasonable suspicion of such a breach, we may temporarily suspend an account.
9. Changes to these terms
We may change these terms with effect for the future, for example for new features or changes in the law. We inform users of changes by email or at the next login. Users who do not agree to a change can delete their account.
10. Privacy
How we process personal data is described in our privacy policy.
11. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for merchants, legal entities under public law and special funds under public law is Munich. Should any provision be invalid, the remaining provisions remain valid. In case of doubt, the German version of these terms prevails.
